For individuals in tax year 2026–27 (1 April 2026 to 31 March 2027), under the Income-tax Act, 2025 as amended by the Finance Act, 2026. New regime: section 202; resident rebate: section 156. Familiar deduction names such as 80C / 80D in general use refer to provisions reorganised under the 2025 Act. Rules checked 5 October 2026.
- Salary standard deduction: up to ₹50,000 old / ₹75,000 new. Employer NPS is added once and the eligible deduction is restricted to ordinary income.
- Old-regime basic exemption: ₹2.5 lakh; resident age 60–79: ₹3 lakh; resident age 80+: ₹5 lakh. New regime: ₹4 lakh for all. Rebate is available only to residents.
- Old-regime rebate up to ₹12,500 at total income up to ₹5 lakh can cover eligible short-term equity and other LTCG tax, but not section 198 equity LTCG tax. New-regime rebate up to ₹60,000 at total income up to ₹12 lakh is restricted to slab-rate tax. Marginal relief above ₹12 lakh is similarly capped.
- Resident unused basic exemption is applied once, to equity STCG first, other LTCG next and equity LTCG last. The equity LTCG annual threshold is then applied. Chapter VIII deductions do not reduce special-rate gains; all gains remain included for rebate and surcharge eligibility tests.
- Surcharge is capped at 15% on covered capital gains. Enhanced surcharge on ordinary income uses the relevant ordinary-income thresholds. Threshold marginal relief keeps gains fixed and reduces ordinary income. Where that is insufficient, the result flags a separate review and may overstate tax.
- Assumes eligible deductions, a single HRA period and correct taxable property annual value. Old-regime property loss beyond ₹2 lakh and carry-forward are not modelled.
- Excludes business/professional income, agricultural-rate integration, dividend surcharge treatment, family pension, virtual assets, winnings, foreign-tax credit, treaty/special NRI rates, AMT, arrears relief, tax paid/TDS and interest or penalties. Land/building indexed-tax protection is not included. This is a tax-liability comparison, not a refund calculation.
- The new regime is the default. Choosing the old regime requires the applicable valid option and timely filing; a cheaper estimate does not establish eligibility.
